Pornhub and XVideos are included

The EU Commission announced today that XVideos, Stripchat and Pornhub are “the largest online platforms” subject to the Digital Services Act. The designation is the result of Commission research which concluded that these three services meet the threshold of 45 million monthly users on average in the EU. As a result, they must comply with general DSA obligations by February 17, 2024. ua

Providing justifications to users if their content is banned or removed.

In addition to the general provisions of the DSA, Pornhub, XVideos and Stripchat are also required to take specific measures within four months to protect online users, including minors, and properly assess and mitigate the systemic risks they pose.

Such sites need further moderation. They must take remedial measures to address the risks associated with the distribution of illegal online content, such as child sexual abuse, and content that affects fundamental rights such as human dignity and the right to privacy when distributed without consent. Removing deepfake porn is also becoming an issue for said services. New features of the Services may include, among other things, their terms and conditions, interfaces, moderation processes or mechanisms.

The Commission services intend to carefully monitor these sites’ compliance with DSA obligations, in particular measures to protect minors from harmful content and to combat the dissemination of illegal content.
