Baldwin posted the picture on her Instagram account, which has an estimated 2.5 million followers. According to the lawsuit, the “Departed” star allegedly referred to Ross McCollum’s involvement in the riot. But McCallum says he wasn’t at the Capitol that day.

The McCollums are now seeking a trial before a jury in upstate New York. It includes invasion of privacy, defamation and intentional infliction of emotional distress.

This is the second case against the actor by the family. The chief was fired after being found incompetent by a Wyoming judge. Alec Baldwin lives in New York.
