Breyers Ice Cream is paying nearly $9 million as part of a class-action settlement — and you may be entitled to some of the money.

The Supreme Court of the State of New York, Bronx District, announced the settlement against Conopco Inc. and Unilever United States Inc. On September 13th. Konopco and Unilever are the advertiser and parent company of Breyers, respectively.

The class action lawsuit concerns Breyers Natural Vanilla ice cream flavor, which allegedly falsely advertised itself as containing real vanilla flavor.

Consumers who purchased natural vanilla ice cream between April 21, 2016 and August 14, 2024 may be entitled to cash back.

Although the jury is still unsure about the authenticity of the vanilla flavor, the defendants have agreed to set up an $8.85 settlement fund for customers who paid for boxes of natural vanilla.

The court will pay consumers $1 for each tub of natural vanilla ice cream flavor they purchased from Breyers.

In order to qualify, consumers are required to provide proof of purchase. Customers with valid receipts are entitled to submit any number of claims that they can verify.

The court allows Breyers customers without proof of purchase to submit up to eight claim forms, bringing the total payments up to $8 per person.

The court also determined that within a year of finalizing the settlement, Breyers would be required to “develop a new product formulation that does not include vanilla derived from plant sources other than vanilla.”
